User Agreement

This website is intended to be a friendly, enjoyable and useful experience. As with conducting transactions in any other medium, there are risks involved and we strongly advise you to understand all of these terms before joining.

Rights to Suspend or Terminate

AllPilots.com reserves the right to refuse service to anyone. You agree that our website, at its own discretion, may terminate any product listing or terminate use of any service immediately and without notice if:

We believe that you are not abiding by the general rules of this website;
You have repeatedly broken a certain term;
You have listed a suspicious or prohibited item;
We believe you to be a non paying bidder;
We believe you to be a dishonest seller;
Your account balance goes above the maximum limit; or
You have provided false information about yourself or others.

Over balance accounts will automatically become suspended. Want-It-Now ads and items you have for sell will also become suspended. In case you have a auction listing with bids already placed, the auction will be continued normally and you remain subject to all terms and fees associated after its closure. Your account can only be reinstated upon payment of all account fees.

Your Conduct

AllPilots.com is a user friendly community. We expect our members to respect each other and behave in a manner acceptable to all. You are solely responsible for the contents of your actions through this website.

AllPilots.com abides by and professes the following guiding principles:

Individuality of members;
The creation of an open environment that enables our members to communicate freely, with proper safeguards from abuse; and
Mutual respect of every member.

AllPilots.com is firmly committed to uphold and promote the stated community values. We encourage our members to do the same to help us in creating an online environment in which everyone can enjoy. Any violation of the community values must be reported to AllPilots.comm for further corrective action.

Offensive Material

You must not transmit any misleading, unlawful, harassing, slanderous, abusive, threatening, harmful, vulgar, obscene, promotional, or other objectionable material on our site. The line between acceptable and unacceptable material is based on the opinions of our site administrators and editors, not by the creator of the content. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

AllPilots.com disapproves the use of any kind of sexual, racist, repulsive or vulgar language and innuendos. It is our policy that the use of such words does not occur on our site. The prohibition extends to all pages accessible to the general public.

If profane words are a necessary part of a title, the user posting the title must blurb out the offending word with asterisk, except the first character. Any breach of profanity rules will invite indefinite or permanent suspension of the members account.

Registration

Your username should not give the impression that your account has permissions which it does not have. It should not contain the terms "admin", "checkuser", "developer", "sysop" or "moderator". In addition, your chosen username should not:

Resemble an existing username;
Contain offensive words;
Promote a company or group that in competition with our site; or
Lead others to assume your account is associated with any person other than yourself or a business that you are not directly associated with.

This website does not permit children (persons under the age of 14) to use the service. Full membership to this website is only available to those you can form a legally binding contract (18 years of age or older). AllPilots.com reserves the right to refuse service to anyone at any time without notice for any reason. Any member that fails to provide his or her correct age upon registration will be terminated immediately.

Intellectual Property Rights

At AllPilots.com, we respect the intellectual property of the third parties. By signing up with AllPilots.com, our members agree to restrain from:

Buying or selling any item that infringe the intellectual property rights of any third party;
Linking to any website, which indulges in or promotes violation of intellectual property rights; and
Uploading a photograph, logo, or any other item without proper permission.

Any member who may infringe or repeatedly infringe the copyrights or other intellectual property rights of the rights owners will be liable for suspension and/or termination of his account.

Although every effort has been made to make sure that all photographs added to the database are photographed and copyright protected by the owner, AllPilots.com assumes no responsibility that the information is correct.

Through our periodic checks, we try to ensure maximum compliance with the intellectual property laws. You are encouraged to report (with full details) any violation of intellectual property rights.

Site Interference

Interference or attempted interference with AllPilots.com is considered as a serious breach of user agreement. Any technological (i.e., software, spyware, adware or any malicious code) or other interference to the content of AllPilots.com may render your account temporarily or permanently suspended. AllPilots.com is a public website and any unauthorized blocking or modification of its content is a punishable offense.

A sum of $100 USD per message will be charged for any commercial message (SPAM) sent via our user contact forms.

Photograph Policy

Uploading images of other people without their permission is prohibited.

Any photo containing comics, celebrities, nudity, violent or offensive material, sexually explicit images, or any copyrighted image (unless you own the copyright) is not permitted. Note: Photos of celebrities and cartoon or comic images are generally copyrighted by the owner.

Any photo that contains personally identifiable contact information such as name, phone number, email address, or web site URL is not permitted due to security and privacy concerns.

You should not use an image that is hosted at another website without the site owner's permission. This is sometimes called "stealing bandwidth" because the image will be loaded from the owner's server.

AllPilots.com reserves the right to review all photos and to remove any photo for any reason at our sole discretion.

Link Policy

If you provide a link on our website to any other website you must ensure that it complies with the following guidelines. Links to pages that are found not to be incompliant with this policy will be removed from our site immediately. Any fees paid for link placement on our site will not be refunded.

AllPilots.com does not allow links to pages that:

Contain the same content as other pages on the Internet;
Are slanderous, libelous, defamatory, or threatening
Reset default home pages, resize browser windows, disable back buttons, or otherwise interfere with a user's ability to navigate;
Have automatic software downloads or self-installing programs;
Have text that is not easily read, (i.e. text that is too small or in an area of the page not visible to users);
Participate in link exchanges or "link farms";
Have excessive pop-ups or other excessive advertising mediums;
Seem deceptive or provide a poor user experience;
Result in a 404 error;
Contain adult content; or
Contain any information that:
- Violates a law or regulation;
- Infringes in any manner any copyright;
- Breaches the rights of any person or entity.

Buying and Selling

This site acts as the window for sellers to conduct auctions or sell in a traditional format. We are not an auctioneer. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to buy items. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

This website shall not be responsible for any items sold by members, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This website shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. However if you fall victim of a fraudulent transaction we will assist you as much as we can.

Sellers assume liability for the content of their item listings. Shipping charges are shown as domestic rates based on the seller's country unless otherwise specified in the listing. Sellers are not responsible for shipping transit times. Transit times provided by carriers exclude weekends and holidays and may vary with package origin and destination, particularly during peak periods.

Prohibited Items

AllPilots.com members will be solely responsible for the compliance of legal requirements for items offered on the site. On our part, we provide a list of prohibited items which can be accessed from the help section.

Use, copy, publish, retain, publicly display, transmit, edit, and create derivative works and distribute any content you post on or in connection to our site; and
Use your name and image for any purpose, including commercial or advertising needs.

You represent and warrant that you have all rights and permissions to grant the foregoing licenses.

Laws

These terms and conditions shall be governed by and constructed in accordance with the laws of the United States and any disputes will be decided only by the Courts of the United States of America.

IN NO EVENT SHALL ALLPILOTS.COM BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH ANY ALLPILOTS.COM SERVICE OR THE USE OF ANY ALLPILOTS.COM SERVICE OR THE INFORMATION CONTAINED HEREIN.
